Wired Music Stole My Photograph!

Stolen Version - Look on the bottom left.

As you can see from the above references Wired Music (Brazil?) used one of my original photographs, in a slightly altered state, without my permission on their commercial site. I sent them an email, in English, and it has been almost a week without a response from them. Does anyone have any ideas on how I can get this issue resolved without having to hire an attorney? I know there is some leeway when you alter another artists work with your own original interpretation but this is a commercial use and they didn't alter it much at all.

I'm so sorry to hear about this. I'm really sad that people use places like deviantART and flickr.com like stock sites. :( I hope you get this sorted out soon.

well if you have a copyright notice on your site saying that no work may be used, altered, blah blah blah without the written permission of the owner and all that jazz you should covered, now unfortantly the only thing i can suggest is sending another, maby a bit nastier, email warning them that if they dont pay/remove the image (whatever it is that you;d like) then they WILL be hearing from your attorney. hopefully you wont have to get one involved.
if you would like legal advise about this you can talk to Jacksilver [link] on here. He may be able to help you out. But my only advise is the same as super-fly, send them another e-mail being a bit more nasty and telling them that if this course continues then legal matters well be pursued.
Have you contacted the US Department of Commerce?

WiredMusic doesnt have any relationship with Wired Magazine do they?
I think Wired Magazine is much more standup about copyrights.
Legally, you ought to send them a letter of demand.

But that entails giving them a set time in which to rectify the problem, by which date if they have not, they are to appear in court......
